Terms of Use

These Terms of Use (the “Terms”) form a binding agreement between you and Black Collegiates (“Black Collegiates,” “we,” “us,” or “our”) and govern your access to and use of our website, mobile application, and related services (collectively, the “Service”). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 17 years old and either a current college student with a valid .edu email or otherwise eligible under criteria we define. By using the Service you represent that you meet these requirements and that all information you provide is accurate and current.
2. Your account
You are responsible for the activity that occurs under your account and for keeping your login credentials confidential. Notify us immediately at toye@thebubblervr.com if you suspect any unauthorized use.
3. License
Subject to your compliance with these Terms, Black Collegiates grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.
4. Acceptable use
You agree that you will not:
- Use the Service to violate any law or the rights of any third party.
- Post content that is unlawful, defamatory, harassing, threatening, hateful, sexually explicit, or otherwise objectionable.
- Impersonate any person, misrepresent your affiliation, or provide false information.
- Attempt to access accounts, systems, or data you are not authorized to access; probe, scan, or test the vulnerability of the Service.
- Interfere with or disrupt the Service, introduce malware, or attempt to circumvent any security or rate-limiting measures.
- Scrape, harvest, or collect information about other users without their consent.
- Use the Service for unauthorized commercial purposes, spam, or bulk solicitations.
Apple users acknowledge that there is zero tolerance for objectionable content or abusive users. We may remove content and terminate accounts that violate these Terms.
5. User content
You retain ownership of the content you submit to the Service (“User Content”). By submitting User Content you grant Black Collegiates a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, create derivative works, display, and distribute that User Content for the purpose of operating, providing, and improving the Service. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights or applicable law.
6. Reporting and moderation
If you encounter objectionable content or abusive behavior, please report it from within the Service or by emailing toye@thebubblervr.com. We review reports promptly and may remove content, warn, or terminate accounts at our discretion.
7. Intellectual property
The Service, including its software, design, text, graphics, logos, and other materials, is owned by Black Collegiates or its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.
8. Termination
You may stop using the Service at any time and may request account deletion as described in our Privacy Policy. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.
9. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. Black Collegiates does not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Black Collegiates and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our aggregate liability for any claims arising out of these Terms or your use of the Service will not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold harmless Black Collegiates and its affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
12. Apple App Store terms
The following additional terms apply when you download the Service from the Apple App Store. You acknowledge that these Terms are between you and Black Collegiates only, not with Apple, and that Apple is not responsible for the Service or its content. Your license to use the Service is limited to a non-transferable license on an Apple-branded product that you own or control, as permitted by the Apple Media Services Terms and Conditions. Apple has no obligation to provide maintenance or support for the Service. Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product-liability, regulatory, or intellectual-property claims; such claims are governed solely by these Terms and applicable law. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties. You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you with respect to the Service.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
14. Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
15. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Black Collegiates concerning the Service. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent.
